Terms of Service
These Terms govern your use of Jun Whisper, a macOS dictation application. By creating an account or using the app, you agree to these Terms.
1. Provider
Jun Whisper is operated by:
Dennis Hellwig (sole proprietor)
Potsdamer Straße 21
14548 Schwielowsee, Germany
Email: hello@junwhisper.com
2. The service
Jun Whisper transcribes spoken audio captured from your microphone into formatted text using cloud-based speech recognition and language models, and inserts that text into the application you are using.
The service is delivered as a downloadable macOS application that connects to our backend over the internet. An internet connection is required — there is no offline mode.
3. Eligibility
You must be at least 16 years old to use Jun Whisper. By creating an account, you confirm you meet this age requirement.
4. Account
- You sign in via Google or Apple. You are responsible for keeping your sign-in credentials secure.
- You are responsible for activity under your account.
- You may close your account at any time from the app's account settings. Account closure deletes account-linked personal data within 30 days, subject to legal retention obligations (see Privacy Policy § 7).
5. License to use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Jun Whisper macOS application for personal or internal business use. You may not:
- redistribute, sublicense, or resell the application
- reverse-engineer, decompile, or disassemble it (except to the extent required by law)
- use it to dictate content that violates the Acceptable Use policy in § 9.
6. Subscription and billing
- Jun Whisper is offered with a free trial and paid subscription plans. Current pricing is shown in the app and on our website.
- Billing is processed by Stripe. By subscribing, you also accept Stripe's terms of service.
- Subscriptions renew automatically on the same day each month unless cancelled before the renewal date.
- Cancellation takes effect at the end of the current billing period; you retain access until then.
- We may change pricing for future billing periods with 30 days' notice by email. Existing subscribers can cancel before the new price takes effect.
7. Refunds
- The statutory 14-day right of withdrawal is available to consumers habitually resident in the EU, EEA (Iceland, Liechtenstein, Norway) or the United Kingdom at the time the subscription contract is concluded, starting on the day the contract is concluded. The statutory notice and the model withdrawal form are here: Widerrufsbelehrung (German, authoritative; an English summary is included on that page).
- For consumers whose habitual residence at the time the contract is concluded is outside the EU, EEA and United Kingdom, there is no statutory and no contractual right of withdrawal; the acknowledgment requested during checkout creates no such right. This is without prejudice to any mandatory consumer-protection law of your country of residence and to the discretionary refund policy below.
- When you subscribe you expressly ask us to start the service immediately. That does not cancel your right of withdrawal — the right expires only once the service has been provided in full, which an ongoing subscription does not reach within the 14 days. If you withdraw during the period, you owe a pro-rata amount for the service already provided and we refund the remainder (§ 356 para. 5, § 357a para. 2 BGB).
- Beyond the statutory withdrawal right, refunds are at our discretion. We typically issue full refunds for service outages exceeding 24 hours and pro-rated refunds when we discontinue a feature you paid for.
- Email hello@junwhisper.com to request a refund.
8. Your content
You retain all rights to the audio you dictate and the text we produce from it.
You grant us the limited, non-exclusive license to process this content solely to deliver the service: speech-to-text, language-model refinement, quality measurement, and — only if you switch on server-side storage — keeping transcripts you can review later.
We do not train AI models on your dictations. We do not use your content to advertise. We do not share content with third parties except the sub-processors listed in the Privacy Policy. If you switch on server-side storage, dictation text may additionally appear in our internal quality-alert notifications.
9. Acceptable use
You agree not to use Jun Whisper to:
- create, store, or distribute content that is illegal, defamatory, harassing, or violates the rights of others
- attempt to bypass usage limits or rate limits
- circumvent security measures or attempt unauthorized access to our systems
- automate dictation in a way that imitates a human user (e.g., bot abuse to inflate usage)
- use the service in violation of export control or sanctions law
We may suspend or terminate accounts that violate this policy.
10. Service availability
- We aim for high availability but do not guarantee uninterrupted service. Maintenance windows, third-party outages (Groq, OpenAI, Cloudflare, Railway, etc.), and force majeure events may cause downtime.
- We do not offer a service-level agreement (SLA) at this time.
11. Beta and experimental features
Some features are released as "beta" or "experimental". They may change or be removed without notice. They are provided as-is without warranty.
12. Disclaimer of warranties
The service is provided "as is" and "as available" to the maximum extent permitted by law. We do not guarantee that:
- transcripts are accurate or complete
- the service will be free of bugs, errors, or interruptions
- the service is fit for any specific purpose
You should not rely on Jun Whisper alone for content where errors could cause meaningful harm (legal, medical, financial, etc.). Always review the output before sending or acting on it.
13. Limitation of liability
To the maximum extent permitted by law:
- Our total liability for any claim arising from these Terms or your use of the service is limited to the fees you paid us in the 12 months preceding the claim, or EUR 100, whichever is greater.
- We are not liable for indirect, consequential, or incidental damages, including lost profits, lost data, or business interruption.
This limitation does not apply to liability that cannot be limited by law (e.g., gross negligence, intentional misconduct, personal injury).
14. Indemnity
You agree to indemnify and hold us harmless against claims arising from your violation of these Terms or applicable law, to the extent permitted by law.
15. Termination
- You may close your account at any time.
- We may suspend or terminate your account with reasonable notice if you violate these Terms, abuse the service, or fail to pay.
- We may terminate the service entirely with at least 30 days' notice.
- Upon termination, sections that by their nature should survive (e.g., billing for unpaid amounts, IP, liability limits, governing law) will continue to apply.
16. Governing law and jurisdiction
These Terms are governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
The choice of German law is not intended to extend statutory rights that EU or German consumer law grants only to consumers habitually resident in the EU, EEA or UK — including the right of withdrawal in § 7 — to consumers habitually resident elsewhere.
The exclusive place of jurisdiction for disputes between us and a merchant, legal entity under public law, or special fund under public law is the controller's place of business in Germany.
For consumer disputes, mandatory consumer protection rules of your country of residence apply where they cannot be excluded by contract.
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
17. Changes to these Terms
We may update these Terms. Material changes are communicated by email and an in-app notice at least 14 days before they take effect. Continued use after the effective date counts as acceptance.
